China Patent Priority System For Study

The essay discusses the patent priority system of China, including internationalpatent priority and domestic patent priority. In the first part, the essay introduces theregulations related to the patent priority in the Paris Convention, the PatentCooperation Treaty (PCT), the Trade-Related Aspects of Intellectual PropertyAgreement (the TRIPS Agreement) and the patent law of China. In the following, theessay respectively analyzes the main aspects of international patent priority anddomestic patent priority. In the third part of this essay, the value of the patent prioritysystem of China is discussed. Also, the essay analyzes the conflict and harmonizationbetween the international priority and the domestic priority. Because in our countrythere are four law regions, which are independent between each other, and manyconflicts of law including the conflicts of priority in patent systems will come intobeing unavoidably, the essay analyzes the conflicts and harmonization of patentpriority under the system of "One Country, Two Systems". Then, the essay discussesthe conflicts and harmonization between the first-to-invent rule of U.S. and China'sinternational patent priority system during the procedures of patent application inChina. In the last part, some constructive suggestions are pointed out so as to reformand improve China's patent priority system.
