Our Probation System Theory And Practice

Suspension of Sentence, as an important section of the whole criminal punishment, has the priority in its application in the society comparing of the Fix-term Imprisonment and Life Imprisonment, so Suspension of Sentence has been widely adopted in the most countries of the world. Criminal Law of the People' s Republic of China has amended Suspension of Sentence on the bases of the application, but it still has the room to be improved in the aspects of the design and the construction. This essay, compared and analyzed the theories and experiences of Suspension of Sentence between our country and foreign countries, firstly focuses on the value of Suspension of Sentence, and then discusses the problems related to the legal conditions and the application of Suspension of Sentence, at the end the essay presents the legislative advisements on the reformation and perfection of Suspension of Sentence on the problems of the essential condition, the negative reflection, the application, the probation and the revocation.
