Originated in Britain more than two hundred years ago, trust has become a cosmopolitan system due to its unparalleled flexibility. As a branch of trust, civil trust has made some considerable progress. However, the speed of its development is relatively slower than that of trust. In this thesis, I focus on the development of China's civil trust. Even though there are lots of dissatisfactions during its development process, the necessity of the existence and development of China's civil trust is undoubted. A lot of scholars including Prof. Jiang Ping, a leading figure in the research of civil law, are very confident about the prospect of civil trust. Nevertheless, the research on civil trust is still on the initial stage and we have a lot of work to do. In my opinion, an in-depth research on the legal system construction of China's civil trust will play a great role in the development of civil trust, as well as have a far-reaching impact on the sound development of China's market economy, the consistent improvement of trust environment and the construction of legal system with Chinese characteristics as a result. This is also the objective of this paper.This paper is composed of four chapters.The first chapter mainly deliberates the necessity and possibility to establish China's legal system of civil trust. It is divided into two sections.The first section makes an in-depth analysis of the necessity of civil trust from different perspectives. It has been proved over the past hundred of years that trust system has unparalleled flexibility to realize its function.
