Reforming The Legal System

With the development of market economy and with the perfect and change of bankruptcy and corporate system, corporate reorganization system came into being and developed, which embodied that corporate legislation thinking has transformed from creditor-protection standard to the protection standard of community overall interests. The community overall interests were deeply concerned by Corporate reorganization system, which guarded against bankruptcy and impelled corporate revival, the function of the upholding community overall interests was paid more attention to by the countries and regions. At present, the countries and regions where market economy was more developed have established a relatively perfect corporate reorganization law system, but in a real sense China has not up to now established corporate reorganization system. With the continuous deepening of China's market economic reform, the corporate reorganization system became more and more importance. Setting up and improving China's corporate reorganization system can not only remedy related law blanks, but also has a positive significance for promoting China's reform of state-owned enterprises and for avoiding social turbulence caused by bankruptcy.The thesis selected corporate reorganization law system as object of study, adopting comprehensively the methods of comparative studies, historical research and positive analysis.
