Environmental Administrative Contract Relief System Study

Environment administration contract is a kind of new management in the environment field. It is used widely in many countries which developed in the environment field. Japan is the earliest country to use environment administration to control the pollution. In our country, environment administration contract was used by the government to affirm the responsibility, power and interest between the manager and the other party by contract in the early time. In the field of our environment management, environment administration contract plays an important part, has intensive foreground .However, because of the different status between the tow main bodies of the environment administration contract, so when the dissension occurred, how to protect the interest of one party is worth to research. At present, the research on the remedy system of the environment administration contract is scarce, so it is difficult to use in practice. This paper tries to discuss the remedy system of the environment administration contract, and mainly include the two aspects that are environment administration remedy and environment civil remedy. However, the remedy system of environment administration contract has some shortage, so in order to consummate the remedy system of environment administration contract, we must strengthen the legislation of the environment administration contract and consummate the remedy system of the environment administration, so environment administration contract will play more important part in practice.In this paper, there are five chapters. The first chapter discusses the background on how to bring the environment administration contract, and analyses the concept, characteristics,classification and functions of the environment administration contract.
