| Since reforming and opening up, market economy is gradually replacing planned economy and becoming the basic economic system. CCP 's Third Plenary Session of the Sixteenth Central Committee indicated market economic system had stepped into the new period of development. Market economy demands government intervention but its attribute of nomocracy demands supervise and control administrative right. The construction of socialistic country under the rule of law is a long-term strategy. As the core of state affairs management, there is no doubt that the administrative rule of law is considered as its key part. Affiliated WTO requests both economic and administrative work link up with global regulations. It also brings forward a new higher request for administrative rule of law. In the new century, the most important task of China is the construction of rich and harmonious society under the theory of scientific development. It can not be realized without the guarantee of law rule, especially administrative law. Under this background, our State Department constituted special regulations in March, 2004.This regulations established directive thinking, basic principles, detailed targets and measures in order to promote the realization of government under rule of law within ten years.Therefore, studying how to realize administrative rule of law under the background of current economy and society has theoretical and practical significance. Many scholars have done great contribution from the aspects of economics, politics, administrative management, administrative law and so on. On the base of these practical experience and theoretical products, this article uses analytical methods of document, comparison, system and case, concern consummating market economy and constructing rich and harmonious society, in order to form relatively clear and reasonable viewpoint of administrative rule of law in accordance with the new situation of our country. |
