The principle of legally prescribed punishments for crimes is one of the three basic principles of the current criminal law in China. To take this principle as a code is an important indication of the effort that China has put in the construction and development of socialist legal system. However, this principle can not be fully imp- lemented in China now due to factors like the changeability of crimes, poor quality of judges, influence of the law -enforcing envi2 ronment. It is suggested that besides strengthening legislation, further investigation of important subjects such as judi2 cial interpretation is needed for perfecting China' s current judicial system.
