Copyright Infringement Crime In The Digital Environment

Digitalization which is based on such information transmission technological instruments as computers, electronic communications and internet has already entered into every sphere of people's life. However, due to comparatively late initiation of the judicial protection for copyright in China which has its protection system for copyright established for only more than a decade, the judicial protection for copyright has not been intensified adequately to adapt to the present fast-developing digitalization, and the study in this regard is far from sufficient. The thesis will take up the infringement of copyright in digitalized settings in three aspects.Chapter One: Digital Technology and Criminal Protection for Copyright. It will mainly deal with the evolution of digital technology and the copyright protection system, and stipulations on infringement of copyright in China and other countries.Chapter Two: Impact of Digitalized Settings on Criminal Protection for Copyright. It will mainly deal with the characteristic conditions for constituting the infringement of copyright in digitalized settings and will manage to find relevant rules through analysis.Chapter Three: How Criminal Protection for Copyright in China can Adapt to the Digitalized Settings. Under the digitalized settings, there are some shortcomings in the enactment of criminal law on copyright protection system, thus weakening the strength of criminal protection for copyright, and as a result, in reality, many criminal cases in copyright infringement have been treated as civil cases. Therefore, it will discuss the issue of how to improve the criminal protection system for copyright through legislative means.
