Civil Retrial System

The civil retrial system plays an important part in the civil judicial procedure in China. It is a kind of supervising and remedy hearing cases system. The current civil retrial system in our country, because of the flaw on legislation, is disputed much in judicial practice and in mess of executing the law. There exists many questions in the present civil retrial system. The main questions are: It's not reasonable for the stipulation of the subject causing the procedure; The reason applying for retrial is too wide and abstract; The procedure examining retrial reason is not legislated; The stipulation on the time asking retrial is not rational; The retrial number of times is not suitable and the retrial range is unlimited, and so on. Therefore, it is urgent to set up modern judicial sense, to rebuilt the theory basis on the civil retrial system and to reform and perfect the civil retrial system in China.
