Divorce Damages System

Proceeding with the concept and characteristics of it, this thesis has drawn a conclusion of the aims and significances of the establishment of system of damage compensation for divorce, summed up its legislation and judicatory at home and abroad and made a corresponding comparison, which will lay a good theoretical foundation for the concrete application, development and perfection of this system.Firstly, closely combined with the practices of judgment, the thesis introduces specific requirements for procedures and entities when the system of divorce damage compensation is applied to judicatory practices; Secondly, by analyzing and comparing the statistics on the basis of investigations on and statistical results of the 8902 cases of divorce heard by a district courthouse during the seven years when the revision of Marital Law has implemented, the thesis has affirmed the applicable effects of the system of divorce damage compensation in our country; Thirdly, for perfection, some suggestions have been proposed in this thesis aiming at problems exposed in judgment practices and some concerning regulations which engender debates in theoretical and practical fields.
