Divorce Damages System

This paper is on the system of compensation for damage in the divorce, which was stipulated by the amendment for Marriage Law in 2001. The paper introduced the history of the system and the current international and domestic legislation conditions, and discusses its ground and constitutions. By pragmatical research, the writer investigated and compared the situations of 2002 and 2005 on the implementation of this system in judicial practice, and analyzed the causes of the unsatisfied situation of the system. Considering the imperfectness of this system in current China, and the parties having insufficient consciousness and being absent of ability, the writer supplied some suggestions on how to perfect and strengthen the system by using the experience of other legislations for reference.
