On The Restriction Of The Death Penalty

The reservation and abolishment of death penalty has been discussed and studied for 200 years. The contradictory parties have their own reasons. However, it will be a historical tendency that the punishment will undergo from heaviness to lightness. Therefore the restriction and abolishment of death penalty is the tendency. Presently, our country can't abolish death penalty and how to restrict death penalty effectively has been a problem which needs to be solved. Our country has signed the International Convention on the Civil Rights and Political Rights. Once it is approved, our country will perform the corresponding obligations in accordance with it. Compared with the International Convention on the Civil Rights and Political Rights, the legislation of death penalty in criminal law of our country has some shortcomings in some aspects such as the application scope, application object, review, restriction and execution of death penalty, etc. Therefore our country should perfect it in all aspects and try to keep up with the international tide.
