On The Common Criminal Negligence

China's criminal law and many scholars define joint crimes as joint intent crimes, denying the existence of the offense of joint negligence , the main reason of which is that criminal negligence is not related to subjective intension linkage .This paper presents that both the offense of joint negligence and joint intent crimes may form two patterns of joint crimes ,and offenders' criminal responsibility is judged by joint principles .The offense of joint negligence refers to over two offenders having the duty of paying common attention ,with common negligence ,commonly fulfil or bring about the act of violating the duty of paying common attention andcause the dangerous result ...... a case of jointcrimes .In joint crimes , each offender is subjectively negligent , displaying "Carelessness" and "excessive self—confidence" . Their intension linkage shows that there is a negligent intension interaction and linkage for offenders in fulfilling the duty of paying common attention .
