Kidnapping offence not only has serious social negative influence, but also hurt others mental health. So, as a result, it always is a target crime all the country around the world to cope with. But there still exist some issues argued in the theoretical and practical field. The paper expounds on some important problems about Kidnapping offence, it can be divided into three parts:The first part is about other countries' legislation on Kidnapping offence. Through comparing, we found that it has different name in different country, but they are same in essence that in order to protect personnel right and property right. In this part, the writer first introduce the historical development of Kidnapping offence in China, then discuss some hot argued problems related to the element of crime, from them, we get the attribute of it.In the second part, the writer discuss the issue of completed crime and attempted crime of Kidnapping offence, and bring forth personnel viewpoints.In the third part, the writer discuss the difference between Kidnapping offence and other similar offence so that it will be useful to practical field. Including the difference between Kidnapping offence and false imprisonment; and distinguish it from racketeering, etc.
