The Probation System Is A Comparative Study

It is not to imprison the measure of punishing to probation as a kind of one that is favored by countries all over the world, have already formed a set of practice systems from adjudicating to carrying out. But the rate of utilization of probation in our country is lower than the country of the probation with comparatively developed system, the penalty value of probation has not been reflected. So, we should take steps to perfect the system of probation. In this article, after applying comparative analysis, the author points out the deficiencies of the system of probation, and makes several suggestions which aim at improving it further and to avoid these deficiencies.The paper consists of four parts. The part of introduction has explained to select title original intention and thinking of research of the text. Part two is the comparative analysis of the applicable condition. The author puts forward that we should extend the probation system to fine and corporation, the personal merit investigation. Part three is the comparative analysis of the probationary inspection in the aspects of the period, the organization, the content. The author suggests on establishing a professional organization of inspection and the system of warranty for probation. Part four is comparative research of the cancellation. The author makes several suggestions that we should establish the prolonged period and the hearing procedures for cancellation.
