As people have attached much attention to the protection of human right in recent years, more and more countries and organizations in the world have formulated the regulations of the exclusionary rule of illegally obtained evidence in legal documents. China is one of the countries, there are no specific regulations in Code of Criminal Procedure, but relevant causes are stated in judicial interpretation/explanation. Especially in past 2 years, the circle of Chinese law theory .and authorities in judicial practice have paid much attention to it and the call of requiring the establishment of complete regulations about the exclusionary rule of illegally obtained evidence have become more serious. The methods including the analyses upon system, comparison and practice are utilized in the thesis. The thesis contains 5 parts, begins with definition and connotation, and the theoretical basis of regulations of the exclusionary rule of illegally obtained evidence and the development of the regulations of the illegal evidence exclusion in some typical countries and the United Nations besides the present situation of the regulations of the exclusionary rule of illegally obtained evidence in Chinese legislation and jurisdiction have been analyzed and discussed.
