Legalization Of Secret Investigative Study

Analysis the secret investigation in the history, we will find that there is a principle in the development of secret investigation, which is the legalization and technology. On the other hand, compared with the western countries, we can find another principle of legalization to the measures of secret investigation, which is useful for implanting the success experiences of them. And that is the aim of this dissertation.So the dissertation includes four parts:The first part is about the history of secret investigation and comparing of the development between our country and western countries. There is a long history of secret investigation in China. In the beginning, the secret investigation was used as military tactics. Then it was replanted to the criminal investigation area. There were abundant experiences about secret investigation in every dynasty in China. And with the pile of the practice experiences, new secret investigation ways accrued gradually. Compared with western countries, Chinese secret investigation was one-upping before QING dynasty. Though the secret investigation way accrued latter than China, they developed very quickly. Especially the recent western secret investigation develops more quickly. Nowadays, secret investigation has been becoming one of the most important ways to fight crimes.The second part is about the concept, nature, function and types of secret investigation. Secret investigation is used to fight with the most serious and difficult crimes. The subject of secret investigation is the criminal investigator, which is the national organ with the power of criminal investigation in criminal procedural law. The object of secret investigation is special object in some special cases. The aim of secret investigation is to fight with the very serious crimes, difficult crimes. And the secret investigation must commit in the law. The nature characteristics of secret investigation is compel lent. Secret investigation must be committed when necessary.
