Towards to the system of fiction admission, it is different from admission about its performance and potency. This dissertation regards performance and potency of fiction admission as two central lines and tries to show the system of fiction admission relatively completely. Through analysing the legislation and the judicial practice, discussing the theory and the practice of fiction admission in own country, the author tries to have a benefit to the construction of the system of fiction admission in our country.The first part tries to extends the constitution and performance from fiction admission' s conception. By using for reference of the legislation of German, Japanese as well as our country Taiwan area, Linking three civil evidence law suggestions which are drawed up by our country scholar Jiang Wei, Tang Wei jian, Bi Yuqian in order to make a more complete introduction on the performance of fiction admission.The second part tries to analyse the potency and theory substratum of fiction admission. Ficton admission is the conduction on the lawsuit which involves two part of the litigants and the court. So the potency of fiction admission aims for court, antagonist parter and the people who makes fiction admission. Because the potency of fiction admission is obtained by law-fiction, so the theory substratum of fiction admission includes source of potency and law basis of fiction admission.The third part, from the view of discovering system's problems, on the foundation of showing the performance and anylazing the potency of fiction admission, the author tries to go deeper the problem in relation to the short of theory research and practice application about fiction admission.
