The modern society of knowledge economy is based on the protection of intellectual property rights. As a highy technology-oriented industry, the Chinese traditional medicine industry demands a good protection in the sense of intellectual property rights. With the trend of returning to nature, Chinese traditional medicine becomes greatly favored by both consumers as well as international medicine companies. In some developed countries, some precious ancient or generationly-passed prescriptions of Chinese traditional medicine are exploited through the form of cooperation, take-over by merging or even monopolized by these companies by abusing intellectual property system. Therefore, it becomes an urgent need for us to utilize intellectual property right to explore international market for Chinese traditional medicine. Now the Chinese traditional medicine industry is facing a powerful challenge from the megacorporations producing medicine.This thesis is composed of three parts:Part Ⅰ: Chinese traditional medicine overviewed in the sense of intellectual property rights. A description of the concept, history and the current circumstances has been given by the writer together with an analysis on the value of protecting Chinese traditional medicine.Part Ⅱ: The current protection of Chinese traditional medicine in China and the existing weakness. The depiction of both the problems and weakness is presented through six different aspects: the protection by copyright, patent, trademark, counter monopoly, administrative law and the protecting measures in the customs.Part Ⅲ: Perfect the protection for Chinese traditional medicine in China. The writer examines this in the following three aspects: 1. Strengthen the common sense of intellectual property right and clarify their objects protected 2. Perfect and systemize the existing legal system for the protection of Chinese traditional medicine. Suggestions such as accelerating the progress of approval for traditional medicine patent etc have been put forward by the writer in this part. 3.
