On Surrendered Identification

The system of voluntary surrender is an important measurement of penalty system in the criminal law in our country. The system is vital because it can encourage and guide criminals to give themselves up to the police willingly and give them a chance to make a fresh start. It can effectively realize the purpose of the penalty which is designed to prevent crimes. However, there have been few systematic observations on the system until now. Based upon the essential characteristics and general theory of the system, the article states and analyzes comprehensively both theoretical and practical problems of the system. This article with more than 40000 words consists of five parts.Part One: Introduction. This part is on the concept, essence and classification of voluntary surrender system. The definition of voluntary surrender is that criminals, within a length of time stipulated in law, state their own crimes automatically, exactly and accept the examination and judgment by the country. The essence of the system is that criminals voluntarily allow themselves to be prosecuted by the country. This part also introduces the classification of voluntary surrender.Part Two: The terms for constitution of voluntary surrender. This part analyses the terms of three kinds of voluntary surrender separately.
