China Contracting Fault Liability Study

Contracting negligence liability means the damage responsibility born by involved parties of contract who breach the precontractual duty against principle of good faith .Contracting negligence liability system has been established in the civil and commercial laws of many countries .The papers studies the Chinese contracting negligence liability in five chapters .The first chapter gives a brief introduction about the development , the law basis and characteristic , the constitutive elements of the contracting negligence liability . The second chapter tells actuality of contracting negligence liability in china , points out some faults and gives some suggestion . The third chapter explains the application of the contracting negligence in china . The forth chapter shows the scope of the damage and the bearing means against the contracting negligence liability in china .The fifth chapter presents the 42 clause , the 43 clause of the Contract Law of PRC . Regulation in contract law of PRC should be definited further more and be perfected .The writer give some suggestion on it in this paper .There must be some shortcoming and omissions due to writer' s limited ability and level .please point them out and revise them if there are any shortcomings or omissions .
