The 21st century is a knowledge-based era, as well as the era of development of network information. With the continuous extension of the network, the resulting network crime would be major problems of the world. In recent years, the sharp increase in the number of cyber-crime, particularly networks and pornography, and money laundering on the net, network gambling and fraud networks become major problems affecting network security which brought very bad social influence, directly endanger the country's political, economic, cultural and other aspects of normal order. Curb cyber crime is imminent. Cyber-crime is so rampant, and for many reasons. There are existing networks own reasons and also the characteristics of the cybercrime itself. Social administrative supervision and legal lag is not due to a number of cyber crime penalties. In addition, one of the reasons is that the network itself can not be overlooked technical security issues. Therefore, legislation, law enforcement and regulatory departments must promptly grasp the most advanced technology and means to improve the detection level, timely repair error of law in order to prevent cybercrime, and truly justice has a long arm.At present, China's research in the theory of crime networks relatively backward, imperfect legislation, charges missing, the sentence was not strong enough, the legislative system is basically in its infancy. This situation with our growing network of crime do notcoincide. So how to prevent and combat crime is the most interesting topic of computertechnology, criminology and criminological research areas.This article attempts to analysis our network problems and shortcomings of crime fromthe perspective of criminal legislation, and make its own recommendations.The aim is toimprove our criminal legislation of cybercrime through my tireless efforts.It is divided into five parts, the first part introduced the basic concepts of cyber crime,cited more representative foreign views, define the concept of cyber-crime controversyexisted a clear reason, and to make my own views.Part II introduced the performance characteristics of criminal networks, including theidentity of the perpetrators of criminal acts and features.
