The freedom of migration is the essential constitution-bestowed right to the citizens in modern society. It is also the basic human tight the citizens enjoy in a civilized. The constitution property of migration freedom results in the fact that migration freedom is guaranteed and stipulated, with some restrictions in every constitution all over the world, and even in the International Human Tight Treaty. After the burning of New China, freedom of movement in China has gone through such a course that is from approval to disapproval and from disapproval to tacit approval of some degree.In fact, constraining migratory freedom is unreasonable and granting migratory freedom to citizens is necessary and caters for the trend. At present advocates for "resuming migratory freedom" speak very loud in every field of the society and migratory freedom has become one of the hot topics in Chinese theoretical circle of constitution. The new leading center of our country brings up the ruling theory of administration for people and authority used for people; love concerned for people and interests strived for people. Therefore, the writer thinks that it is necessary and feasible to acknowledge freedom of movement inn our constitution. .Except the introduction this article consists of three parts.Part 1 defines domestic migratory freedom as that in the scope permitted by the law and in the premise of right guarantee, all citizens have the freedom to choose and change residence. Next this part explores the nature, legal status and value of migratory freedom.Concerning the freedom of migration, some problems should be made into from the aspect of right, whether it is the organic part of the citizen's fundamental right and is included in it, and whether it should be stipulated definitely in the constitution.Part 2 the author discusses the necessity and possibility of migratory freedom of writing in our constitution.
