Labor Contract Law Study

With the development of market economy and the strength of company became more enhanced, the employer do a lot of damage to the interests of the employee. The individual labor contract law, as one of the important measures to protect the employee, has already been stipulated by many countries.In compliance with the China' s Labor Law, the individual labor contract shall regulate the rights, obligations and responsibilities arising from employment, the procedure of concluding a individual labor contract, the relationship between the two parties to the individual labor contract and other matters of importance to the employee and the employer.For this reason , The draft bill of China' s Individual Labor Law which is discussing should make the proviso that the employer conclude the contract with the employee , perform the contract and discharge the contract. Especially a contract is discharged by the employer for the reason of bankruptcy or other reasons like that.I discuss the validity of the individual labor contract in this thesis and put forward my own idea.
