On The Principle Of Punishment

This paper consists of four parts, including preface and three chapters of the main body. In preface explain the history of the principle of punishment. The first chapter is about the principle of balance of crime and punishment, discuss its basic meanings and theoretical base, point the principle claim punishment should balance to the harm of crime, discuss mainly the theoretical base: retributionism which claim use punishment avenge crime and utilitarianism which claim use punishment prevent crime. The second chapter is about the principle of personification of punishment, discuss its basic meanings and theoretical base, point the principle claim punishment should balance to the threat of criminal, emphasize its theoretical base: The third chapter is about the accommodation of crime and punishiment ,discuss its representation in legislation and judicature.
