The life of human being is the highest and valueless personality interest and is the first value of human being. As the object of the right of life, life is the ability to realize the people's living. The right of life is the first right of natural person, and is the base and precondition of any other civil right. In china, for the sake of comparative omission of the basic law such as the general rule of civil law, there is no uniform standard for the damage to death in the course of legislation, administration and justice. It is an important step to consummate the law of tort in china that the supreme court of china's interpretation on several issues of application of law to hear the case of damage to person is valid in may l^st, 2004. In the head of China legislates the code of civil law to make the uniform and perfect standard of damage to death, we should reinforce the research of the issue and protect the interest of party in maximum sense.The article focuses the damage to death, and discusses several issues.
