On Civil Liability For Medical Damages

In recent years, with the development of the society and the increasing consciousness of protecting the rights and interests , the cases of compensation for medical damage have increased rapidly in our country which leads to the big dispute about dealing with this kind of cases in judicial practice. Essentially medical damage belongs to the field of civil liability among which the relief to the rights and interests of the patients is the most important and direct. This article analyzes the characteristics of civil liability of medical damage from many aspects such as the summation, constitution, the principle of imputation and the allocation of burden of proof of civil liability of medical damage, etc. In the meantime, the author puts forward her own opinions about perfecting the system of compensation for medical damage combining it with present law, regulations. The article uses methods of comparison, demonstration and history.The article includes four chapters except the introduction and conclusion.
