The national educational examination is an exam system that is organized, authorized and monitored in the name of a country, and is implemented within the national wide, Schools (other educational institutions) authorized or the institutions implementing the exams are capable to award the educational experience, the degree certificate or other exam certificates, all of which are valid all over the country. The national educational examination, the great event concerned by the whole society, plays an important role in cognizing, selecting and employing the talents scientifically and equitably. However, the problems existing in the exam discipline are outstanding, and the phenomenon of cheating is fairly serious. The law system of punishment for cheating behavior is very weak, especially represented by the fact that the legislation in relation to the punishment for cheating behavior is faulty. This article focuses on the issue of the legislation associated with punishment for cheating in the national educational examinations, and analyzes the faults existing in the current relevant legislation field in depth, as well as putting forward the reasonable consideration of consummating the relevant legislation. The whole article includes four parts mainly. Part one briefly summarizes the definition, characteristics as well as all kinds of the national educational examinations. It also analyzes the purpose and effect of the punishment for disobeying the exam discipline or cheating, considering qualitatively, the punishment should be categorized into the behaviour of administration punishment. Part two discusses the important status of the legislation about the punishment for cheating in building the national law system and implementing the national educational examinations. Part three expatiates on the processes of the existing relevant legislation and also on the relevant rules set for the principal part, the authority, the category and the procedure of the punishment, as well as the possible methods of saving the wrong doers.
