It has cause of legislation and cause of departing from the basic spirit of legislation on programme of performance, It have cause of juridical resources's lack and lack of judgement. These question result in the programme of check of death penalty not to give scope to the function, the author think the programme of check of death penalty should be reformed and perfected, legislation should build new programme of check of death penalty to be satisfied with reality and need of the human rights.But also the law is set:"death penaley is checded by the supreme people's court."right of check of death penalty is important authority of office of supreme people's court, right of check of case of part were award to High—grade people'court by the supreme people's court by modifying law of organization of people'court to cooperate strict beat in 1983. how to operate it, how to give scope to its function,how to perfect it, how to ensure the quality of case,this arouse universal attention of boundary of jurisprudence become problem of hot point in criminal law and criminal juridical territory.The article have three partsThe first part introduce thinking of the legal principle and investigation and analysis of present conditions.it includes the value of the programme of check of death penalty,understanding of it, its developmeut,its analysis of present conditions and serious abuse of right of check as it transfer to a lower level.The second part is comparison's ressarch of cheek system of death penalty,it includes characteristics of it in Chinese ancient times and its stipulation in foreigh country.
