Some Problems On The Crime Of Money - Laundering

As a new kind of crime, crime of money laundering appeared in the second half of the 20th century, which was following the development and overflowing of the international crime of drugs. The establishment of this crime has reflected a kind of common understanding of the international community, namely, the intent to inhibit the drug-related crime of the upper reaches by cutting off its fund-circulating chain. Later, people gradually found that it could bring about a very strong effect of inhibition by this means, not only to crime of drugs, but to other organized crimes and property crimes. That's why money laundering has been regarded as an offense in the penal codes of most countries.Consequently, as a signatory of a series of international treaties signed against money laundering, our country set up the crime of money laundering in the new criminal law in 1997 so as to fulfill the international obligation. But surprisingly, from 1997 to 2004,in more than six years after this crime was established, there was not even a true case which was convicted as the crime of money laundering in judicial practice .It shows that the criminal law clause of money laundering is inconsistent with the actual life. So the author will explain in this article why the crime of money laundering was difficult to be applied in reality. This text is made up of preface, main text and conclusion, the main text is composed of four parts:Part one discusses the historical development of crime of money laundering, which was composed of two stages. One stage was the course in which loot-related crime was separated from afterwards common crime of the upper reaches, and the other one was the course in which crime of money laundering was separated from loot-related crime.
