On Sexual Harassment In China And Regulations System

The appearance of sexual harassment has a long history, but the legal study on it has only begun from 1970s in American, which is the first country in the world proposed regulating the sexual harassment by legislation. In China, sexual harassment has become an issue arousing increasing interest since several years ago when the first case of which appeared in Xi an. Our country haven't explicit provision still, how to comprehension it in terms of the civil law, what measure shall be adopted to prevent which, and how to give relief to the victim by protecting the right of sexual freedom, all of that is the research aim in my article. This dissertation is comprised of four parts besides introduction and conclusion.Chapter I focus on the summary of sexual harassment. Firstly, introduce the origination and developing history of its definition, then give my conclusion sexual harassment is not a kind of sexual discrimination. Secondly, sexual harassment should bring grave harm to the victim mind, so the legislation on which is very important and necessary.Chapter II focus on the basis of regulating the sexual harassment by civil law. Firstly, synthesize the academic point of view what kind of sexual harassment infringe, analyze the relationship between the action and some particular personality right. Then conclude that we should take the stand on protecting the right of sexual freedom of the natural person, and introduce the conception, character and right of composition of the sexual freedom which is a kind of independent personality right.Chapter III introduce the legislation rules of sexual harassment in other countries and Taiwan and Hongkong, compare to them, now we can only find some principled formulation from our law. So it is urgent to legislation on the sexual harassment in China in view of the present situation.
