| International Factoring is a kind of comprehensive financial service which includes investigation of commercial credit, management of account receivable, guaranty of credit risk and trading financing. It has developed more than 30 years over the world and promoted the international trade greatly, but it was just at the beginning stage in our country. While during the last few years, with China's entry into the WTO and the opening of finance market, more and more foreign banks have poured into our factoring market, then our commercial banks have gradually become aware of the importance of International Factoring and began to develop and promote it on a large scale. However, because of the complexity of this service and the deficiency of related laws, it is very necessary to analyses the legal issues of it before we develop it further. Therefore, this thesis devotes to respectively analyses the legal relationships of all parties, the choice of laws, the conflicts of right of priority and the prevention of legal risks on the basis of the contents, and then considering how the commercial banks to develop and promote the International Factoring service further, the author gives his suggestions from the perspective of law. |
