As a new tourism type, timeshare enjoys broad marking prospect and it have an active impaction on economy of China. However, there is a series of problems in its development, needing legal regulation.This article pays attention to relevant legal issues of timeshare, summarizes and analyzes these issues, introduce its legal characteristics. And then, the paper point out problems in and countenneasures for present domestic timeshare.The author attempt to establish legal regulation system to promote further well development of timeshare in China.This article consists of five chapters.Chapter 1 is a comprehensive introduction of timeshare. First, the paper introduces the meaning and history of timeshare in China and foreign countnes.The author makes a new attempt to define the concept of timeshare in this article. Second, the author bring out a new measure to classify timeshare, make it to three types. And also proceeds to explore the essential of timeshare form the standpoint of microcosmic and macroscopic .Third ,by adopting chart as the analytical tool, the paper make an analysis of timeshare parties and legal relations between them .This chapter makes people have a basic impression of timeshare and also laid the groundwork for following introduction to other chapters.The second chapter is an analysis on the two types of timeshare, purchases of shared property ownership and purchases of the right to use. After enumerating different views on timeshare legal nature of law scholars in China ,the author put forward a new point that purchases of shared property ownership timeshare can be classified to two types -shared property ownership system and property hotel .which the former is a time-limit ownership ,and the latter is estate ownership .With the real estate ownership theory ,the paper analyzes the legal nature and character of the shared property ownership system .In addition ,this chapter also points out consumers' rights and interests in the type of the right to use timeshare.Chapter 3 contains a analysis of timeshare consumer guarantee system.First,the paper emphasizes the necessity of establishing guarantee system .Then ,the article introduces...
