Modern judicial system regards the defendant as very important role, while doesn't protect the victim's rightness well. To strengthen the protection of victims, I investigated the status of victims in criminal lawsuit from different aspects, to prove the rationality of victim's litigant status in lawsuit Because in the crime procedural legislation in our country there exists some realistic defects on the protection of the criminal victim in lawsuit, I have offered some suggestion to improve the status of victims.Part one: The implication and features of the victim in criminal lawsuit is introduced. I introduced the features mainly from the view of criminal procedural law. Therefore, as a victim, his right must have been violated and this violation must be straightly. This violation should be capable of recovering. He desires to revenge very much. And as a witness of the crime, his words are very important verbal evidence.Part two: The contrast study of the status of victims, including the comparing through the history and between countries. The aim of this contrast is to introduce different elements which influence the status and rightness of victims.Part three: Victims should be given the litigant status in lawsuit To demonstrate it, I have given some reasons for my conclusion .Firstly; I have compared different views about the status of victims. Secondly, I have tried to introduce basic theories which support my view. Thirdly, I have introduced the value of litigant status of victims.Part four: The present situation of the legislation about victims. I have analyzed for the most part the difference between the crime procedural law nowadays and the one before modification.Part five: The defects of legislation and the solutions to some questions. A Summary: I reaffirmed my view on the status of victims. Then, I emphasized some principles on perfect of legislation.
