Legal aid system, which is also called legal remedy or legal assistance, is a judicial remedy system adopted generally by most nations to provide legal service reducing or remitting fees to those who have economic deficiency and cannot afford legal service fees or litigants of specific cases. Intrinsically, it is national obligation protected by the state and backed by state despotic power. It is national responsibility which should be assumed by modern legal states. It represents the level of construction of legal systems and the level of recognition of human rights protection. So it is called "Hope Project" within legal regime. China's legal aid system was germinated in 1994, validated by Criminal Procedural Law and Attorney Law in 1996 and formally established by Legal Aid Ordinance issued by the State Council in September 2003. Currently, this rising legal system is becoming an organic part of our country's legal system and playing more and more important part in political, economic and social life. Legal aid system is a kind of legal guarantee system of modern society. After a decade of gestation and preparation, China's legal aid system is eventually established, symbolized by the issue and execution of Legal Aid Ordinance. Presently, academe's research concerning theory, legislation and practice of China legal aid system lacks systematization, profession and originality. Frontier issues are rarely referred. This thesis attempts to put forward some immature but creative suggestions about theory of China's legal aid system, with a view to construct China's legal aid system appropriate to national conditions in China, to explore and research reforms of China legal aid practice.
