With the emergence of knowledge-based competitive economy and the rapid progress of technology, the practical and potential value of genetic resources, traditional knowledge and folklore has been realized and recognized by countries all over the world. The protection of the above-mentioned subject matters is not only helpful for the sustainable development of the mankind, urgent for preserving biodiversity and culture diversity, but also one of the key points for developing countries to safeguard their national interests at this new era of knowledge-based economy.This paper begins from the classes and property of genetic resources, traditional knowledge and folklore, analyzes the possibility and feasibility to protect them, makes a general introduction about relevant discussions and practical legislation actions in this area by some international organizations and typical countries, gives an overview about the current situation in China, then points out that "although the international world has paid much attention to the protection for genetic resources, traditional knowledge and folklore, so far not much common points has been reached. Not to say to establish a kind of effective protection system, there is not even a shared view with the conceptions. Differences remain not only between developing and developed countries, but also between developed and developed countries, developing and developing countries. Thus, for China, as a developing country with its own special features, should not only refer to foreign expertise and experiences, but also bear in mind the present circumstances of its own economic and technical levels as well as the future expectations and needs. In a word, China should deal with this matter with strategic thinking" , and finally concludes with some suggestions for China' s future work in this area.
