| The Book of Changes is an all-inclusive book which embraced a collection of knowledge about sky, ground and people. The Book of Changes is known as the"source of flowing water" in Chinese traditional culture, which is also regarded as"the head of books of Changes" by the advocates of Confucianism, and conceived as" the best of San Xuan"by the Taoists.The Book of Changes is saying the information that comes from the former society in its own language —Shi,Gua,Yao and Guayaoci. Although The Book of Changes is a reference book on divine in ancient China, there were contents about the legal system of the Yin and Zhou dynasties recorded in it.The writer studies the legal systems in the Yin and Zhou dynasties with many reference books such as Chinese Legal System History, Yixue Lunzhu and the scholar's researches .This thesis studies the legal systems in the Yin and Zhou dynasties from four aspects :the legal thoughts, the criminal legal system , the civil legal system and the judicial system , which will contribute to the study for the source of Chinese traditional legal culture. Because the legal ideas and systems in the Yin and Zhou dynasties have exerted a great influence upon the legal system of later dynasties.To date,some of the legal ideas and systems in the Yin and Zhou dynasties can be used for reference .It contributes to the source that we investigate the Chinese traditional legal culture.Firstly, the Book of Changes involves the legal thoughts. For example,"Shichuyilu"in Shigua comfirms"Xingqiyubing",one of the views of the Chinese legal origins.In some parts of oracle inscription in the Book of Changes,the view of"Deity" was recorded,but the ruling class of the Western Zhou dynasty added "People",emphasized"Virtue"and downplayed"Sky". The royalty standpoint had been very flourishing. The ruler of the Western Zhou dynasty valued the importance of people, which was reflected in Tongren, Duigua,Yugua,Guan,Lingua, etc. Moreover, the thought of"noble morality and cautious punishment" brought about influence on the Book of Changes such as Henggua,Yigua and... |
