In recent years, the administration of justice has played a more and more important role in our political life, economical life and social life. But together with the compelling achievement, un-satisfaction with the administration of justice rose. In order to change the passive effect, the judicial organization made quick reform, while it was not effective. The author think the reason why the administration of justice met such puzzle is that people didn't exactly realize the essence of the administration of justice, which they simply looked it upon just a kind of country power, operated in a power pattern. The power judicature exhibits the following: people's higher courts administrate the people's lower courts and the chief justice assumes overall responsibility for the work of the people's court where he served, hierarchical judiciary structure, etc. According to the external administration of justice, the exhibition of power judicature can be found everywhere. There are so many reasons why power judicature still prevails, such as culture, economy, politics and social structure. But now the power judicature can hardly accommodate itself to the need of development of the situation, and it has become embarrassed. The author keeps the point that we should establish an authority pattern of the administration of justice to help it to get out of the puzzle. The modern administration of justice incarnates an authority on jurisprudence. The essence of the authority judicature is estimation; its operating precondition is rational and systemic and that its subject should be courts and judges.
