Traditional Chinese medicine, one of the Chinese cultural traditions, has been received much recognition by the world. It is imperative to strengthen the international protection of Intellectual Property rights of Traditional Chinese medicine along with the broad spread and use of Traditional medicine. This thesis, basing on the theory and practice of Traditional Chinese medicine, discusses and analyses the scopes, methods and limitation of the protection of Traditional Chinese medicine through the study of international intellectual property system. Also, the author proposes to form a synthetical protection of Intellectual Property system of Traditional Chinese medicine, to reinforce the literature management of Intellectual Property of Traditional Chinese medicine, to impel the modernization and internationalization of Traditional Chinese medicine properly, to develop the international cooperation of technique and intellectual property of Traditional Chinese medicine, to diminish the gap of intellectual property between the developing country and the developed country, to perfect the conception and system of traditional knowledge so as to solve the problems existing in the development of Traditional Chinese medicine.Chapter one expatiates the scope and the importance of intellectual property of Traditional Chinese medicine by introducing the Traditional Chinese medicine, Traditional medicine, Western medicine and making a compare of them according to their difference.Chapter two discusses the methods of international protection of intellectual property of Traditional Chinese medicine, such as the existing Intellectual property system (patent, unfair competition, trademark, copyright) and the new area of Intellectual property (traditional knowledge) as well as their advantage and disadvantage basing on the scope of intellectual property of Chapter 1.Chapter three summarizes the derivation of the international protection of intellectual property of Traditional Chinese medicine through the introduction of international organization, treaty and some representative countries.Chapter four lists the main difficulty faced by Traditional Chinese medicine when seeking the international protection of intellectual property.Chapter five describes the author's opinion to the defects of international intellectual property protection of Traditional Chinese medicine so as to perfect the international system of intellectual property protection of Traditional Chinese medicine.
