Nvocc Financial Responsibility Guarantee System Research

Based on the elementary theories of NVOCC and the model of bond in operation, the article analyzes the financial responsibility requirement of NVOCC both in America and PRC. Furthermore, this article studies the necessity of establishing the model of bond and the financial responsibility requirements for NVOCC in PRC and methods of improving this system.The general guideline and frame of this article are as follows:Chapter one first analyzes the legal concept of NVOCC in terms of current regulations and theoretic views in America and PRC and then introduces the establishing process of NVOCC in PRC in view of historical evolution of NVOCC. Moreover, this chapter makes discussion on the speciality of NVOCC's legal status and probes into the original responsibility regulated for NVOCC, which makes foundation for further analysis on responsibility beard by NVOCC in following chapters.Chapter two begins with the concept of surety and compares financial responsibility for NVOCC with similar systems in other business, then introduces current system of financial responsibility requirements for NVOCC in PRC, namely the model of bond system. In addition, chapter two makes comments on this system and offers proposals to it.Chapter three makes a presentation of Shipping Act of 1984 of America and one of detailed rules for implementation PART515—Licensing, Financial Responsibility Requirements, and General Duties for Ocean Transportation Intermediaries and gives analysis to the financial responsibility requirements of NVOCC in America by focusing on its various forms and flexible mechanism in operation.With all works mentioned in above chapters done, the article comes to the conclusion, the meaningful part of this article, which involves in the opinions of...
