The question of Terminal Handling Charges (THC) is an important matter under dispute in international shipping circles. Since liner conferences introduced THC in China with effect from 2002, the move to collect THC had triggered outraged protests from Chinese exporters and importers. Liner companies and merchants have been debating about the issue whether liner companies can collect THC, how they collect THC, etc. These questions concerned about transport contract, trade contract, and the traditions in shipping and commerce. So it is a complex issue. On 18 April 2006 the investigatory authorities declared the conclusion relating to the investigation on the collection of THC, however, the effect from the dispute still exists. In this article, the author wants to discuss this problem through several sections, hoping to draw some conclusions.In the light of the above contents, this thesis consists of three parts including the introduction, the text and the conclusions that arranged as follows:The introduction presents the issues to be discussed, the method and the goal of the subject.Chapter 1 outlines the produce of the THC and the issue of THC in China.Chapter2 analyzes the reasons of conflict on THC. The different opinions about THC lead to the conflict between shippers and carriers. The author focuses on four aspects to disclose the reasons of conflict, and discusses the conclusion of the investigation, moreover, the different opinions about the legal nature of THC. This section compares three opinions of the nature of THC through natural character and social character. The author regards that THC was in nature a component of international container transport freight, but in social character an illegal charging.
