The thesis is about the legal position of unincorporated society, used logic, compare, history and other research methods. There are five parts in all. The first part is about general situation of unincorporated society, including definition, characters, actuality and problems in practice. The second part is about legislations and practice in other countries and regions, including Germany, Japan, Taiwan region of China, and areas in Anglo-American law system. The third part is about some different views from academe on the issue in China. The fourth part is about reasons for granting unincorporated society civil subject. The fifth part is about assumption to grant unincorporated society civil subject position in civil law legislation in China. In addition, after unincorporated society becomes civil subject, many problems may appear, and some regulations in Anglo-American perhaps have use for reference.The question about unincorporated society has existed for much long time, and many experts researched it for long. Before the first civil law come out, it is significative to study the question in the round. The creative outcome of this paper is that the conclusion is based on abundant information and thorough research.
