Procuratorial Organs Investigation And Supervision System

Investigative power is a privilege that the investigative organization owns to process things or people compulsively. Without effective restrictions and protective measures, the operation of investigative power may jeopardize citizens' safety or infringe the suspect's litigation and human rights. Therefore, investigative power must be supervised. In our country, the procuratorial organs perform the supervision on investigative power. Taking the procuratorial organs' supervision on the public security organs as an example, this thesis will discuss the problems exist in the supervision system on investigative power. The thesis consists of 5 chapters. Highlights of the contents are as follows.The first chapter provides general introduction to the procuratorial organs' supervision system on investigative power in China. This chapter describes relevant regulations and characteristics of the supervision on investigative power, analyzes whether the procuratorial organs should own the juristic supervision power, and briefly discusses the history of supervision on investigative power, existing issues and how to improve the supervision system.The second chapter carries on the research on the examination system on arrestment in China. First, the author presents the current status of the arrestment system and existing problems in China, analyzes the reason that warrants of arrest should be issued by the procuratorial organs, and explains why arrest mechanism is applied extensively in the judicatory practice. Then, the author discussed the measures to improve the arrestment system in legislation and practice. The measures include: strengthening the judicial characteristic of the arrestment power, restricting the power of the denouncement organs, and improving the remediation measures in arrestment system.The third chapter is a research on the procuratorial organs' supervision on criminal investigation. The author believes that criminal register belongs to investigative procedures. Strengthening the supervision on criminal register is an important part of strengthening the supervision on criminal register. Because of the imperfectness of legislation and legal practice, there are many problems in the procuratorial organs' supervision works on criminal register.
