Intellectual Property Protection Of Traditional Medicine In China A Number Of Issues Discussed

Chinese traditional medicine has systematic theories, abundant clinical experiences and vast medical documents. But the loss of intelligent property right in Chinese traditional medicine has been shocking very much. It's very urgent to enhance to protect intelligent property right in Chinese traditional medicine. On the basic of reference and combining some theories, my text analyzed requirement of the protection for the intellectual property of traditional medicine, the scope of the protection for the intellectual property of traditional medicine, the pattern of the protection for the intellectual property of traditional medicine, and shared mechanism of benefits for the intellectual property of traditional medicine.The full text is composed of three parts except prelude and epilogue.In the first part, on the basic of the range and characters of traditional medicine, I analyzed the scope of the protection for the intellectual property of traditional medicine and requirement of the protection for the intellectual property of traditional medicine.In the second part, I analyzed and summed up the lawmaking mode of our country and some foreign countries. And I emphasized the importance of establishing the opposite independence pattern of legislation that protecting the intellectual property of traditional medicine.In the third part, I explored the shared mechanism of benefits of theintellectual property of traditional medicine. On the basic of referenceand combining some other country's theories, I hope that our country should establish this mechanism by lawmaking.
