Price discrimination is very common in business communications. price discrimination made by monopoly enterprises may be one of important forms of abuse in anti-monopoly law. The price discrimination system is an important legal system closely relating to the subjects of the market economy. However, the price discrimination system in China is not perfect enough to satisfy the demand of the market economy which is developing rapidly.In this dissertation I take the comparative method. Compare the differences of legal systems in China and foreign countries, and probe the track and features of development of price discrimination. In the first part of the dissertation, a description on the definition and features of price discrimination and an overall review of legislation and cases in European American and China, and an analysis of theories and principles in this field are presented. In the second part of the dissertation, a new requirements structure of price discrimination are put forward to after an overall review of legislation and cases in European and American. And the fragments of requirements structure of price discrimination were analysis one by one. In the third part of the dissertation, I discuss the proper reasons for enterprise to made price discrimination. At last s the specific legislative proposals offered in the dissertation. With the intention to improve the legislation and practice of price discrimination, the deficiencies are pointed out based on the study of positivism and comparison, and the specific legislative proposals are put forward in the dissertation.
