Family Court Study

I'd like to elucidate the necessity and feasibility of establishing Family Court in our country.The first part begins with the definition of Family Court. Then, family cases, or the objects of Family Court, are systematically recounted. Despite of different prescription for the range of family cases in different counties, it is basically accepted that identical cases, such as matrimonial cases, parental cases, and bring-up cases, should be included. Therefore specific judicatory and social function of Family Court is determined and the features of Family Court are discovered.In the second part, it is pointed out that all around the world the particularity of Family Court has been noticed, thus the complete structure of Family Court has been or being established respectively in different countries. I'd like to give some introduction in detail about current situation of Family Court in some countries, and its affiliated facilities. Family Court system in Japan, which sets up unitive courts with specific judgers, investigators, and mediators, and at the same time sets up a procedure of family trial in Procedure Law, is relatively the most wholesome one among them. This example can provide some reference for us in the future.The current situation and shortcoming of Family Court system in our country is analyzed in the third part. The necessity for setting up Family Court is reiterated in four perspectives. And then two projects are discussed: setting up specific Family Court or setting up Family Court in lowest common court. Personally I believe the latter one is more reasonable and feasible. On this basis, selection of judgers, and equipment of assistant stuff is discussed. Finally, I also dissertate the necessity and feasibility of setting up a system for inquisitor to participate family trial.
