| As a basic human right, sexual right has long been neglected to some extent by the legislative body and scholars in legal field. The right comes from the constitution and is legalized by the Civil Law. With deep jurisprudential, ethical and humanistic value, it includes the rights of gaining of gaining sexual pleasure, keeping the right in one's own hands, health protection, self-protection and etc. At present in our country the legislation pertaining to this right has many imperfections, esp. with regard to the interference from the public rights. It is believed that an exact definition and proper demonstration of the intrinsic value of this right can be valuable for the protection and regulation of it. The meaning of proper regulation of this right lies in the protection of legal sexual behavior and the obstruction of sexual harassment and other illegal behaviors. |
