| People is the supreme essence, the final purpose, value-pursuing of law. Law just exists for people, who should be the logical starting point and ending home of law. Legal system originates from the system arrangement of their existence, value and fate by human beings, behind which, the principle of taking people as the foremost is the supreme spirit to determine its fate and developing direction.Carl Marks critically inherits the Western tradition human-centered thinking and forms the thought of taking people as the foremost. It criticizes the disadvantages of the past human-centered thinking, then establishes the philosophical content of Mark's thought. His thought is about to produce the theoretical value and practical significance on the construction of our modern legal system.The construction of our modern legal society taking human as center requires the corresponding legal conception. Chinese traditional legal institutions are in short of the senses of freedom, democracy, equality, and the individual selfish departmentalism. This thesis aims at advocating to construct a legal society, which takes human as the foremost; which insists on the principle of democracy, freedom, equality; setting up the legal spirit of human-centered thinking. Finally let people depend on the legal institutions and take them as liable value standard and pursuing goal and establish the human-center basement for our legal building. Thus the final legal goal and value concern can be shown. The harmonious development between human and society can be realized. |
