Study Of China's Financial Derivatives Transactions Legal And Regulatory System

In the 20 years financial innovation focuses on derivatives especially as futures and options in financial international markets, and the transaction of financial derivatives develops very quickly. The original intention of financial derivatives is to meet the need of risk evasion and hedging, but we cannot exclude some people who are partial to risk use it to gamble and make profit, that's because when we use derivatives to evade kinds of risks we do not need to input much capital. So there is some uncertainty lying in the transaction of financial derivatives, which will cause severe economic loss, make financial institutions bankrupt or destroy financial order. So it is very important for us to take rational supervision system and reinforce the law construction.The article starts from the angle of law, synthetically adopt the research method of comparison analysis and historical analysis. There is some shortage lying in China's legislative supervision and managing system of financial derivatives transaction. In order to accelerate the development of China's derivatives market safely and effectively, I want to consummate China's legislative system and managing system by consulting some developed countries'(or areas') experience.The article is composed of four parts expect introduction and epilogue. The first chapter is the summarization of financial derivatives. The second is mainly about the comparison of derivatives'legislative supervision system in several developed countries (and areas). Next, the author talks about the China's actuality of financial derivative's legislative supervision and analyze the shortage of it. The fourth part talks about how to consummate China's legislative supervision system of financial derivations transaction.
