Textbooks should be especially attention by the copyrighttheory circles due to their important status in the educationand their important functions in realizing the goal of ourcountry cultivation. There are only a few provisions in the 1990Copyright Law on the problems about the copyrights of thetextbooks in principle, because of the restriction of thehistory and the recognition of the people then. The difficultieswill arise due to the ambiguity of the statutory provisions.The following pages contain an attempt to discuss thecopyright ownership of the textbooks and to reduce the disputeduring the compilation and the publishing of the textbooks.Therefore the writer did a thorough analysis from four aspectsby means of logically analytical method, interests measurementmethod and method of comparative law as well in the thesis.Firstly, the textbooks have the copyright or not. Secondly, whoshould hold the copyrights of the textbooks. Thirdly, whatsupport should the government deliver to the copyrights of thetextbooks. Fourthly, we should how to perfect the protection ofthe copyrights of the textbooks.The emphasis of the thesis is the copyright ownership ofthe textbooks. The copyright ownership of the textbooks isdifferent in virtue of the different features between theprimary and middle textbooks and the college textbooks. Theclear and obvious feature of the primary and middle textbooksis the close together with the government's conduct. Textbookswill not healthily development without government supportingand administration. The copyright ownership of the textbooks should belong to our country according to establish a specialadministrant committee to manage it. College textbooks can bedivided into two types, the textbooks by yourself and theplanning textbooks, and the copyright ownership is alsodifferent. The copyright ownership of the textbooks by yourselfcan be confirmed according to the provisions of the CopyrightLaw; the copyright ownership of the planning textbooks shouldbelong to the writer.
